Probate is the process whereby an executor establishes the validity of the Last Will & Testament of a deceased person. An executor is responsible for gathering estate assets, paying valid debts and taxes, and distributing remaining assets to the named beneficiaries in the Will.
When someone dies without a Last Will & Testament, that person is said to have died "intestate". Depending on the size of the estate, an administrator must be appointed by the courts to settle an intestate estate. Often this requires a proposed administrator to post a bond. Once an administrator is qualified by the court, they are responsible for gathering the estate assets, paying valid debts and taxes, and distributing the remaining assets to heirs who inherit by law.
